Welcome to Touch The Soul. By accessing our website soulevents.ca and purchasing our products or services, you agree to be bound by these Terms and Conditions. Please read them carefully.
1. Business Information
Touch The Soul is a balloon artistry and event decoration business operating in Toronto and the Greater Toronto Area (GTA), Ontario, Canada.
2. Products and Services
We provide balloon arrangements, event decorations, and custom design services. Product images on our website are for illustration purposes. While we strive to match images as closely as possible, slight variations may occur due to balloon availability, color batches, and the handmade nature of our products.
3. Ordering and Payment
- All prices are in Canadian Dollars (CAD) and include applicable taxes unless otherwise stated
- 13% HST (Harmonized Sales Tax) is applied to all orders in Ontario
- Payment is required at the time of order placement
- We accept Visa, Mastercard, American Express, Apple Pay, and Google Pay through our secure payment processor (Stripe)
- Orders are confirmed only upon successful payment processing
4. Delivery
- We deliver within Toronto and select GTA areas
- Delivery fee is $25 for orders under $200. Free delivery for orders $200 and above
- Delivery times are estimates and not guaranteed. We will contact you if any delays occur
- Someone must be present to receive the delivery. We are not responsible for items left unattended
- Please provide accurate delivery information. Additional charges may apply for failed deliveries due to incorrect addresses
5. Custom Orders and Quotes
- Custom design quotes are valid for 7 days from the date of issue
- A 50% deposit is required to confirm custom orders
- Final balance is due before delivery/pickup
- Custom orders require a minimum of 5 business days notice
6. Cancellation and Refund Policy
- More than 7 days before event: Full refund minus 10% processing fee
- 3-7 days before event: 50% refund
- Less than 3 days before event: No refund (materials already prepared)
- Custom orders: Deposits are non-refundable once design work has begun
- Quality issues: Contact us within 24 hours with photos for a resolution

7. Product Care and Liability
- Balloons are perishable items. Helium balloons typically last 8-12 hours; air-filled arrangements last 3-7 days
- Keep balloons away from heat, direct sunlight, sharp objects, and extreme temperatures
- We are not liable for damage occurring after delivery due to improper handling or environmental conditions
- Balloons contain latex, which may cause allergic reactions in some individuals
8. Intellectual Property
All content on this website, including images, designs, logos, and text, is the property of Touch The Soul and protected by copyright laws. You may not reproduce, distribute, or use our content without written permission.
9. Limitation of Liability
Touch The Soul's liability is limited to the purchase price of the products or services ordered. We are not liable for any indirect, incidental, or consequential damages arising from the use of our products or services.
10. Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, severe weather, pandemics, or supply chain disruptions.
11. Governing Law
These Terms and Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
12. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes become effective immediately upon posting. Your continued use of our services constitutes acceptance of any changes.
